Homeowners Prevail in Overturning Unlawful Arlington County Zoning Amendment
Gifford Hampshire and Wendy Cousler successfully challenged the Arlington County Board’s unlawful enactment of a zoning ordinance amendment. The amendment sought to allow large multiplexes in neighborhoods traditionally reserved for single-family homes. Giff and Wendy demonstrated to the Arlington Circuit Court that the County Board had violated state law in multiple ways. As a result, the Court declared the ordinance void, protecting neighborhood integrity and upholding state zoning laws.
