B&K Secures Settlement for Complete Relief as Requested in a Private Nuisance Dispute Between Neighbors
Gifford R. Hampshire and Thomas F.X. Walsh received favorable settlement terms for a client in a land use dispute with their neighbor. The client came to Blankingship & Keith due to their neighbor's continued encroachment on their property in a disputed portion of land, specifically an easement, between the two parties’ properties. Pursuing a private nuisance lawsuit, under Va Code Sec. 55.1-305, Hampshire and Walsh were able to get the offending neighbor to agree to cease the disruptive behavior now and in the future.
This case illustrates the often complex nature of boundary and land disputes between properties in Northern Virginia and awkward results the disputes can cause for neighboring parties. Northern Virginia, with its rich and long history, is rife with land use abnormalities and property rights for many properties that are always neatly shaped or solely owned.
